Terms of Service

Acceptance of these terms

By creating a Fitnessage account or using the Fitnessage mobile or web applications, you agree to these Terms of Service ("Terms"). If you do not agree, do not use Fitnessage. These Terms form a binding agreement between you and Fitnessage.

What Fitnessage is

Fitnessage is a fitness and longevity platform that estimates a biological age from physical assessments, generates AI-personalised workout and meal plans, integrates with partner gyms, and (where available) coordinates meal-delivery orders. Fitnessage is a software product — not a healthcare service, medical device, or substitute for professional advice.

Eligibility

You must be at least 13 years old (16 in the EU) to use Fitnessage. By using Fitnessage you represent that you have the legal capacity to enter into these Terms.

Your account

• You are responsible for keeping your login credentials confidential and for all activity under your account.
• Provide accurate information — fitness assessments are calibrated against the data you enter.
• Notify us immediately at support@fitnessage.ai if you believe your account has been compromised.

Subscriptions and billing

• Premium features are available via a paid subscription, sold on the web at fitnessage.ai. Pricing, currency, and trial length are shown at checkout.
• Subscriptions auto-renew at the end of each billing period unless cancelled in advance via the subscription-management page.
• You can cancel any time before the next renewal — cancellation takes effect at the end of the current billing period; partial refunds are not provided.
• Trials convert into paid subscriptions automatically when they end unless you cancel during the trial.
• Stripe processes all payments. We do not store full card details on our servers.
• Mobile apps distributed via the Apple App Store and Google Play do not sell subscriptions in-app — purchase happens on the web. The app verifies your subscription status and unlocks Premium features for subscribed accounts.

Meal-delivery orders

• When you place a meal-delivery order, the order details and delivery address are forwarded to the meal-delivery provider you selected for fulfilment. Fitnessage is not the food merchant.
• Orders become locked at the cut-off time configured by the provider. Locked orders cannot be modified or cancelled through Fitnessage.
• Refunds for delivery issues, missing items, or food quality are handled directly by the meal-delivery provider per their own policies.
• Subscription deliveries renew weekly unless you skip, pause, or cancel before the cut-off.

Acceptable use

• Do not abuse or attempt to subvert the service: no scraping at scale, no automated mass account creation, no security testing without written permission.
• Do not post or transmit unlawful, harassing, hateful, sexually explicit, defamatory, or otherwise objectionable content to community surfaces such as gym leaderboards or shared rankings.
• Do not provide unlicensed medical advice, promote eating disorders, or encourage self-harm.
• We may suspend or terminate accounts that violate these rules, and remove content within 24 hours of a credible report.

Health disclaimer

Fitnessage assessments, biological-age estimates, and AI-generated workout and meal plans are based on general population norms and machine-learning models. They are NOT medical advice and not a substitute for professional diagnosis, treatment, or monitoring. Consult a qualified physician before starting any fitness or nutrition programme, especially if you have a health condition, are pregnant, or are taking medication. Stop exercising immediately if you experience pain, dizziness, chest discomfort, or shortness of breath.

Intellectual property

Fitnessage, the Fitnessage logo, and all software, content, and design elements of the service are owned by Fitnessage or its licensors. You receive a limited, non-exclusive, revocable licence to use the service for your personal, non-commercial use.

User content

When you submit content to Fitnessage (e.g. notes, ranking entries, gym reviews) you grant Fitnessage a worldwide, royalty-free licence to use, display, and store that content as needed to operate the service. You retain ownership of your content; deleting your account removes the content from public surfaces.

Termination

You can delete your account at any time from Profile → Delete Account in the mobile app or at fitnessage.ai/delete-account. We may suspend or terminate accounts that violate these Terms. Upon termination, your access to Premium features ends and we delete personal data per the Privacy Policy.

Disclaimers and limitation of liability

Fitnessage is provided "as is" without warranty of any kind. To the maximum extent permitted by law, Fitnessage is not liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to your use of the service. Our total liability for direct damages is limited to the amount you paid Fitnessage in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability — in those jurisdictions our liability is limited to the maximum extent permitted by law.

Governing law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of New South Wales, except where local consumer-protection law gives you the right to bring a claim in your home jurisdiction.

Changes to these terms

We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use of Fitnessage after that period constitutes acceptance of the updated Terms.
